I am working in a private limited organization. My appointment order is issued for a period of one year, and every year they issue a new appointment order for the following year. In this situation, are we eligible for gratuity after completing 5 years? Please clarify this.

If your joining is done with the completion of your full and final settlement and the issuance of a new Appointment Letter, it becomes challenging to prove continuous employment for 5 years, making it difficult to claim Gratuity. However, if you can prove that the break is sham or bogus, you have a chance to claim the same.
