Employer Not Signing PF Forms: What Can an Ex-Employee Do to Claim Their PF Amount?

If an employer doesn't sign the PF forms, what action will be taken regarding the employee who has left the organization for the last year and wants his PF amount? Kindly advise.

You can withdraw your PF even though the employer does not attest your form. Your employer has no authority to hold your PF or stop it. It is maintained with the PF office, a government body, and your employer has no control over it.

Steps to Withdraw PF Without Employer Attestation

However, before applying for the PF, make sure of two things. You must have your PF code number with you. The second one is that the employer has deposited your PF with the Department and has filed necessary returns with the office.

Now, just fill in the withdrawal form (10c and 19) and get it attested by your Bank Manager. You can deposit this form at your regional PF office where your account has been kept.

Employer's Responsibility in Attesting PF Forms

In my opinion, if an employer fails to attest and send the filled-up forms to the RPFC within 5 days, the employer can be prosecuted. The employee may get the form attested from any of the prescribed authorities and send it to the RPFC with a request to either settle it or get it attested through their Enforcement Officer and settle it. If joined in a new establishment, they may get the account transferred to the new establishment through HR.
