Understanding Leave Eligibility in IT Software Companies

anitakanwar
Greetings to all,

I am working in an IT software company, and we have a policy to provide 1.5 leaves per month to every employee as CL & SL in total. However, I want to know when an employee becomes eligible to take CL/SL. For instance, if someone has joined on 1st March, can they take 2-3 SL after 10-15 days of joining? If so, according to which rule or law are they eligible to take leave?

Dear Ms. Anita Kanwar,

The provision of leaves pertaining to the number of CL, SL, and EL is governed as per state regulations. Additionally, any employee joining the organization is entitled to CL and SL from the first day of joining the services.

CL can be taken during the year-end as it stands lapsed if unused. SL can be taken as desired and is carried forward to the next calendar year.

Conversely, EL is allotted to the employee only after the completion of one year of continuous service (in the year an employee should not have worked less than 240 days), which is counted starting from the calendar year.
