Minor Injury - wanted to know that is any regulation that has an age limit?

Dear Sir, Today in our factory one Incident occurs while doing civil work by a subcontractor. Minor injury takes place. The injured person is 60 years old. I wanted to know that is any regulation that has an age limit? Our management took objection on old man due to his age.

Hi Vaibhav,
There is age limit that 58 or 60 years, every one has to retried , i hope there is no age limit in private sector.
If it is labor work do not risk through recruiting the people those who are having more than 50 years and saying that we should be always in place of safe zone.

The Age Limit is fixed as per the work demands. If the works involved are doing laborious work then as per the requirement the organisation can reduce the age limit. Normally if the worker maintain good health and physique then you can engage them after they complete the Pre employment Medical examination. As per Building & Other Construction Workers Act, the workers engaged must undergo Periodical Medical Examination after every 2 years, if they are below 40 years of age and those above 40 years of age they have to undergo Periodical Medical examination every year.
Those who are performing only advisory duty they can be employed even upto 70 years.

I do not know the upper limit to mark out if or not the person is eligible.
My view point however is, If you are employing a person it is a company's responsibility for the safety and accidents that occur in the workplace. How is life related to age? Just because a person is old do not mean his/her life is any less valuable to the young people. I believe that when management did not consider the age while recruiting him and getting their tasks done from him, how do they explain bringing the age factor into consideration while compensating someone for the accident that occured that the workplace?
It might not be mandatory as per the rule, but don't you think out of goodwill if the company atleast pays for the medical bills and give some compensation amount, it would really make them look good in the books of the staff they're working with?
Just a thought.

I appreciate Ms. Ankita Shah's opinion. As the accident has already occurred, its not the time for the management to formulate max age policy right now. A workman encountered with an on duty accident has to be extended all treatment, WC as per WC Act 1923 or ESI ,whichever applicable , and reports and benefits under the Factories Act 48 or Building & Other Construction Workers (RE&CS) Act 2005,whichever applicable. Yes, max age policy, either 58 or 60, is necessary keeping the Safety and Occupational Health provisions of applicable acts/rules in view but same has to be enshrined in the rules/agreements for future guidance.

it is simple that if any person who is working in any establishment get injury he should be compensated . pay compensation and deduct from contractor. always say to contractor for this matter.finally u must understand that it is the liability of principle employer to compensate inured person.there is no upper age limit for working any where however there is discretion on u to keep such age group person in ur establishment or not if u keep u hve to bear all consequences.suppose a person dies in factory police will be involved and matter will be complicated.
Basic funda of employment should be understood first. child labor is prohibited but not the old. but it is u to decide the employment of upper age group.
