Is Your Company Ignoring Employee Rights? My Experience with Overwork and Mistreatment

My name is Arun. My company faces facility problems, and I have little knowledge of English. Hence, I feel more comfortable communicating in my mother tongue.

Madam, I work at a company called Coimbatore Crispsystem. Here, approximately 126 members are employed. There are no facilities for the employees, and they are subjected to overwork and mistreatment. Employees are bound for one year and subjected to severe stress. After one year, they are released by being pressured to quit. Every year, those who work here endure unbearable conditions without being able to leave. All employees, whether they are B.E., Degree, or Diploma holders, work as programmers but are treated poorly by being made to clean tables and chairs. Unfortunately, an employee died due to work-related tension and stress. When will new employees who come to work here face the same fate?

Some employees work throughout the night until 5 o'clock in the morning due to company pressure. If they try to leave the job because of this, they are threatened. Before one year is completed, some are unfairly taxed without proper notice, and now a false accusation has been made against them. This company has an ISO 2008 certificate, but we lack basic facilities. Please help me, Madam.

- Monthly CL leaves not granted
- Discrepancy in salary experience for existing employees and new joiners

This is Arun, working at Crispsystem, an ISO 2008 Certified IT company in Coimbatore. In this company, there are 126 employees. There is only one bathroom for all the employees, which is not maintained properly. The bosses are subjecting the employees to various types of mistreatment. As a result, employees do not stay for more than a year of service. They do not receive PF or ESI benefits, and there are no CL benefits available to them. The municipal authorities have permitted the construction of only three floors, but the company has already established their office on the fourth floor as well. There is no specific working hour policy for the employees. Arun seeks guidance from the members on how to address the challenges they are facing.

Advice on the Situation

My simple advice regarding this situation is to quit the job and search for a new opportunity where one can excel. If one wishes to file a complaint against the company, it could potentially lead to additional problems.

@Mr. Arun: Has your HR brought these problems to the attention of management yet? If yes, your issue is not only strenuous, but you also need to finally understand that the above-mentioned IT company does not prioritize the well-being and benefit of its employees. Not only does your current company exhibit these practices, but there are also hundreds of such SMEs (Small and Medium Enterprises) that use sly and deceitful means to terminate employees, only to hire and subsequently let them go.

Being the sole individual to struggle and defend oneself can often be a futile effort, potentially resulting in job loss in the process. To prove your worth, you should align yourself with an organization that genuinely values its employees.

If not, consider writing a letter or email addressing the same concerns to HR and observe the response. In the absence of any initiated changes, you may want to start preparing for an alternative job that offers you mental peace and satisfaction.

I do not agree with Mr. Bhasker's comments because these are common problems in small-scale industries. Even though companies deduct ESIC and PF, they are not paying. How long do we have to run away from these problems? Can you explain how HR executives should handle this situation?

Addressing Non-Compliance with Indian Rules and Laws

Please talk to management about the consequences that need to be faced if the organization does not comply with Indian rules and laws. If they do not respond, provide the necessary emails on the matter. Even then, if they do not respond, we have only one option - "we work for the salary."

Even I faced similar issues in my previous company. With the help of seniors on this site, I struggled there for 7 months. However, I later quit that job due to depression issues. I was the only one raising these kinds of issues. Later, I realized that there was too much politics, so undoubtedly, management was not going to take action. In these types of companies, there is nothing called management; they work as proprietors. They are biased as per their needs. I think one should talk to colleagues or seniors, and if nobody is there, then consider quitting the job.

In such a case, please do involve statutory authorities. Like in your case, Pooja, you should have complained to the Labour Commissioner of your local area, PF authorities, and ESI authorities. They could not have escaped. In the present case, I can assure you that contacting the local Labour Authorities would surely make much of a difference.
