Employee Absconding During Probation
We have an employee whose performance review was pending to confirm the probation. Before the probation completion, we had set up a meeting, and from that time onward, he stopped coming to the office without properly informing us. After multiple follow-ups through different channels, he finally showed up after 2 weeks. He informed us that he would like to resign and requested that the relieving be done on the same day. He is okay with being marked as absconded if we do not provide the relieving and experience letter. As per the employment contract, if he resigns, he has to serve a two-month notice; otherwise, if he wants relieving on the same day, he has to pay two months' notice pay. The employee did not agree to either term and absconded. We had no choice but to send a termination letter along with notice pay recovery. Could you please advise on what should be the next action from the employer's end?
