Gratuity Nomination Setup: Who Can Help and How to Get Started?

Hi all, until now, we have not set up Gratuity Nomination. Could anybody suggest how to do this? Also, I would like to know who the authorized persons are for this process.

Please check the Payment of Gratuity Rules Book. Make the format of the Nomination Form and take sufficient prints. Get it filled by the employees available in your company and keep it along with the Personal Records of the employees.

Hi Ashok, For gratuity nomination, obtain the form as per the statutory requirements of AP. Nomination is applicable for employees who have successfully completed 1 year of service. After completing one year, you should fill out the form and keep it for records.

Is there any registration of AP for Gratuity, and what is the process? If the employer is not willing to establish a gratuity fund, what is the role of the HR department?

Can I get the gratuity rules from your end if you have them?

Nope, I have no rules for that. Gratuity is part of the Shops & Commercial Establishments Act. No organization shall skip the gratuity. It is mandated as per the statutory requirements.

Please obtain the Payment of Act/Rules book and prepare Form F. Have the employees fill out Form F, which is readily available at the stationery shop. You can also find other labor law-related forms and stationery items there.

Please get the bare Act (wherein the details are given in brief) updated copy of The Payment of the Gratuity Act, 1972. The present limit of Gratuity is Rs. 10 Lacs. The applicability, eligibility, various forms like nomination, claim forms, and other rules are mentioned therein. When you go through the bare act, all your doubts will be cleared.
