Yes, it is applicable. Hope you might have obtained the approval for the construction of the factory from the Inspector of Factories. After approval, you can start the construction of your factory. Once the manufacturing process is commenced, then automatically the BOCW Act applicability will cease, and the Factories Act will be applied.

Applicability of the Act

The Act is applicable to all establishments that employ 10 or more individuals in building or other construction works. Managerial and supervisory personnel with a salary above Rs 1600 per month are excluded. It provides for the health, safety, welfare, etc., of workers, similar to the Factories Act.

You need to contact the local labor department to obtain the registration form if you have awarded a construction contract to someone else. 1% of the total cost as labor cess will need to be deposited by you with the BOCW department.
