Salary During Prolonged Medical Leave

Anupam015
I met with an accident while coming back from office around 6 months back. I was driving my own two wheeler.
Due to accident, I was on bed rest and in recovery for three and half months. While on leave, provisionally salary was given for 1 month. After that my salary ws stopped without any intimation. After joining back, my company has only given sick leave for mere 12 days and has denied me any accident leave. Salary was also not given for rest of the period.
HR representative is saying that all of the days would be treated in LOP or my Privilege Leave would be adjusted. Provisional salary would be recovered from my upcoming months pay.
Also no claim was entertained by my company for any group insurance benefit for my case.
Request you all to pls guide in this matter. Is there any act or rule under which I can claim any compensation.

As per Shop and Establishment Act Sick Leave is allowed for 12 days only. You could take any privilege leave or annual leave coupled with sick leave, the rest period will be treated as Loss of pay. If you are in coverage of ESI, you could get ESI leave as per rules.

Your employer is correct and please ask whether they have any kinds of mediclaim policy/ESI coverage or other benefits to the employee.

Hi,
I have been working my organisation since past 4years and now my employeer wants me to work in night shift. I have 2.5years old kid and I am not comfortable in doing night shift. My employer is not understanding my situation. Can anyone advice how to handle this situation without changing job?
Thanks!
