Facing Salary Cuts After Accident Leave: Can I Claim Compensation?

I met with an accident while coming back from the office around 6 months ago. I was driving my own two-wheeler. Due to the accident, I was on bed rest and in recovery for three and a half months. While on leave, a provisional salary was given for 1 month. After that, my salary was stopped without any intimation. After joining back, my company has only given sick leave for a mere 12 days and has denied me any accident leave. Salary was also not given for the rest of the period.

The HR representative is saying that all of the days would be treated as LOP, or my Privilege Leave would be adjusted. The provisional salary would be recovered from my upcoming month's pay. Also, no claim was entertained by my company for any group insurance benefit for my case.

Request you all to please guide me in this matter. Is there any act or rule under which I can claim any compensation?

Sick Leave and Compensation Under the Shop and Establishment Act

As per the Shop and Establishment Act, sick leave is allowed for 12 days only. You could take any privilege leave or annual leave coupled with sick leave; the rest period will be treated as a loss of pay. If you are covered by ESI, you could get ESI leave as per the rules.

Your employer is correct. Please ask whether they have any kind of mediclaim policy, ESI coverage, or other benefits for the employees.
