How Can I Obtain My Relieving Letter and Experience Certificate After Termination?

Hi all, this is Paul. I worked for Mahindra Satyam (Hyderabad/Andhra Pradesh) from 19th Feb '10 to mid-March '12. I wasn't keeping well at that point, so I called my team lead and informed him of the same. I was admitted to the hospital, followed by other personal/sensitive problems which I cannot disclose here, during which time I received a termination letter, and now they are not ready to give me my relieving letter. Now that things have finally started to settle down, I want to pursue my career. I want my relieving letter and my experience certificate, paying the dues to the company if there are any, so that I can apply for a job. Kindly advise on how I can get my clearance from the company. It would be nice if I could get the contact number of someone who would be able to assist me in this regard.

You should directly approach the HR Department and discuss the issues you are facing, whether they are personal problems, family issues, hospitalization, or the need for bed rest at home. Show them the termination letter you have received. If you have a soft copy, print it out and keep a record of it. Then, request them to issue a clearance certificate so that you can be cleared from all sections. Submit the certificate and request a relieving letter, an experience letter, and the Last Pay Certificate.

If they are unwilling to provide clearance, ask them to withdraw the termination letter and request to regularize the long absent period as Leave without Pay on special grounds. If you approach the situation professionally, the HR Team and the Management are likely to assist you.

As you did not serve your notice period, the company was justified in giving the termination letter. A relieving letter is given in case the employee resigns formally and completes a proper handover of responsibilities, which you could not do in this case. Therefore, you may not be able to obtain the relieving letter.

However, you can request an experience certificate from them, which will serve as proof that you worked at the organization for the specified time period. This certificate can be provided to your new organization, along with a valid reason for the gap in employment.

Additionally, you may consider reaching out to your former reporting manager to seek assistance in obtaining the necessary clearance.

Thank you for the information provided. I did try talking to my HR as well as the HR Manager, but that did not work out. I am just worried. I have tried all possible ways to get my relieving. Kindly advise.

Hello All, As stated, I am ready to pay my dues if there are any. The only thing I want is my relieving experience from the company for the tenure I was with them. I am eagerly waiting for a response and a way out.

Termination Clause in Appointment Letter

What is the termination clause in your appointment letter? For example, does it specify a one-month notice period or salary in lieu of the notice period?

Then, once again, approach the HR Manager and submit your plea along with your hospitalization proof. This should suffice for your employer to provide the experience letter. A relieving letter, in your case, is not applicable as you have not given any handover of your responsibilities, and it was not required in your situation. I am sure that on humanitarian grounds, they will provide you with the experience certificate.

I agree with Saji that the only thing you can get in this case is an experience letter. Try to request the same. Relieving from the duties is completely out of the question here as it's already been over six months, and the company surely must have hired a new person in your place long back. What responsibilities and dues do you think you are left with in that organization?

In my opinion, ask them for an experience letter, which you might receive as it's a statement of your tenure in the said organization. In case you are unable to obtain the same, you can use your appointment letter, salary slips until the last month, or bank records to prove your employment with the last organization.

One last question: if I use my appointment letter, salary slips until the last month, or bank records to prove employment with my last organization, and there is a background check/verification at the new place of work, would they not allow me to continue if the previous employer gives negative feedback? I guess getting my experience certificate would be safer to prove it. Please, I need all your valuable suggestions.

When it comes to background verification, it mostly pertains to your past performance. If you left your last job for the reasons you mentioned, there should be no issue in sharing this information with your future employer. Any complaints from your past employer would likely align with what you have already disclosed to the new company. The problem may arise if your version of events differs from your past employer's.

However, this discrepancy may also occur even when you provide an experience letter. Just be confident in yourself and truthfully present the facts if asked. If you have the skills and qualifications, you will find the right opportunity regardless.

You should tell the truth about your problems, including your termination, when discussing with HR and your lead manager during the interview. This honesty will benefit you even if your background verification results are negative.
