Struggling to Get My Final Settlement and Letters After Resigning Without Notice – Any Advice?

I was employed in a non-permanent capacity at a reputable LTD organization. After submitting my resignation via email, I left the organization instantly, without serving the notice period. However, I did inform my team verbally about my decision to resign. Regrettably, the Regional Head did not accept my resignation.

For the past three months, I have been attempting to secure my Full and Final settlement, Experience, and Relieving letter. However, these processes have been indefinitely delayed.

I would appreciate any suggestions on a course of action to obtain these necessary clearances.

Do you agree/accept being terminated by the company on the same day? Normally, for an absconding employee or an employee who does not serve the notice period, the company doesn't provide the relieving letter or experience letter. Please check your company's policy for clarification.

Notice Period Clause

What is your notice period clause? If it is one month or three months, the company reserves the right to claim any outstanding dues from you and provide your Full and Final (F & F) settlement balance or recover the amount from you.

Understanding Company Policies

Every company has its processes and policies in place. It is a universal truth that any employee who does not serve a proper notice period will not receive an experience and relieving letter, nor will they be eligible for the Full and Final settlement, even if they are an off-role employee.

The only way forward is to either complete your notice term or pay a salary in lieu of the notice period. However, whether the company accepts the notice pay is entirely at their discretion. They may insist on you serving the notice period, especially if your position is critical.

You have not mentioned the reason for not serving the notice period, but please understand that the notice period is a time the company buys to hire a replacement and for you to hand over your tasks.

I recommend checking with your hiring manager and/or reporting head for further guidance.

If you are an off-role employee, then you must obtain the experience letter, relieving letter, and F&F settlement only through your service provider. If you have not fulfilled the employment terms and conditions, then you cannot expect others to fulfill your requirements.

I hope you attended the exit interview, during which they may have informed you about the non-acceptance of your resignation letter. Why did you not try to convince the Regional Head about the necessity of your resignation and make it a positive experience?

Please send a letter to your ex-employer requesting the issuance of a clearance/relieving letter and Full & Final Settlement. You can also provide instructions to deduct the notice period buy-back amount and any other dues owed to the company from your F&F Settlement.

Pending Full and Final Settlement

I have worked for one company for more than four years in the sales department, and as per company rules, I served a one-month notice period. I have accrued almost 52 earned leaves (EL) and 15 days of salary, along with almost 20 months of pending conveyance from the employer. Even though four months have passed since my last working day with the previous company, they have not released my Full and Final (F&F) amount. Every time I inquire about my F&F with my employer, they inform me that there are pending dues from the market, and once those are collected, they will release my amount.

Please help me out or suggest ways to obtain my pending amount.

Steps to Resolve Employment Clearance Issues

Please speak to your boss or HR and understand what they now require to relieve you. Most likely, they may ask you to deposit basic pay for the duration of your notice period (in most cases, one month only) and settle your dues. Also, talk to them and try to pacify any issues they have. You may also check the possibilities of adjusting your balance leaves in your notice period and settle. In short, take the middle path.

If you desire to showcase the experience in your resume for future employment, then it's mandatory that you obtain a relieving letter from your last employer. It's important for your career, not just for them. Please make a note of it.
