Hi James, hope you are doing well! As per my knowledge, for both PF and ESI registrations, your company should be registered under the Shops and Commercial Establishment Act, 1961. The employee count should be a minimum of 20. Once your company headcount reaches twenty, you can start the registration process for PF and ESI.

As per Aisha, it's mandatory that when your company hires the 20th employee, you should register your company under PF and ESI. Even for one member, you need to comply with the Shop and Commercial Establishment Act. I believe you also need to register under the Professional Tax Act.

Even if there are fewer employees, you should opt for ESI & PF registrations on a voluntary basis. Of course, registrations for Shops & Commercial establishments as well as PT are mandatory.
