One of our employees joined on May 7, 2012. She is now requesting maternity leave. Please let me know if she is eligible or not.

Thanks,
Neha

If your employee has completed 80 working days, then she is eligible for maternity benefits.

Yes, as she has completed an 80-day period, she is eligible for Maternity Leave.

If she works 80 days in the year before her expected date of delivery, then only she is eligible. Hence, we have to calculate based on the EDD.

If you are covered under the ESIC benefit, then you will not be entitled to maternity benefits under the Maternity Benefit Act 1961. There should be at least 10 employees, and if there is any woman among them, then maternity benefits would be provided. You must have been working for at least 80 days, and you need to give notice of leave at least 6 weeks in advance, mentioning the dates. Then you will receive maternity leave with wages.
