Confused About Gratuity Eligibility After Company Transfer – Can Anyone Clarify?

I have been working in a group for 9 years. Meanwhile, I transferred in 2009 to a new company within the same group under the same Managing Director. At the time of transfer, they moved my service to my current company. Now, I have resigned from my job, and they have informed me that I have only been working in this company for 3 years; therefore, I am not eligible for gratuity benefits. I have the letter for service transfer. Kindly clarify my doubts.

In the transfer letter, they wrote: "We are transferring his accumulated 10-year group service and accumulated leaves along with his transfer with effect from 1st July 2009. He is eligible for all allowances which may be available at the plant."

Kindly clarify.

First, you should go to the HR manager and discuss the issue of gratuity. If they are unwilling to provide it, then you can escalate the matter to the DLC (District Labour Commissioner) for further resolution. The DLC will help solve your problem.
