What Happens if a Non-Employee Worker Gets Injured? Exploring Insurance Options for Hamalis

primemover
I wish to know if the factory engages a hamali for loading some material. He is not a regular employee and is not registered under the ESI. If he meets with an accident while performing the given job and causes injury, what benefits will the hamali be entitled to? Can they be covered by any form of health/group insurance, similar to vehicle insurance (third party)?

ESI Act Coverage for Factory Employees

Is the factory covered under the ESI Act? Is the employee a direct employee or employed through a contractor?

He is only entitled to compensation and damages from the employer. No other claims will be entertained.

It won't be covered under ESI because he/she isn't a temporary/permanent employee. So, you need to cover Workmen's Compensation/Employees' Compensation insurance.
