Do I Need to Submit Form XXIV Under the Contract Labour Act in Maharashtra?

Kindly let me know if I need to submit the form under the Contract Labour Act of 1970, as my organization is in the state of Maharashtra.

FORM XXV
[See Rule 82(2)]
Annual Return of Principal Employer to be sent to the Registering Officer for the year ending 31st December.

This is in A.P. Please check if it is the same in Maharashtra State.

As your industry is located in Maharashtra, you must submit your annual return using Form 21. Form 25 is not applicable to you.

Form XXIV Submission Requirements

Dear All, kindly let me know if I need to submit Form XXIV under the Contract Labour Act of 1970, as my organization is in Maharashtra state.

This form must be submitted if your company is working as a contractor. If your company is working as the principal employer, you have to submit an annual return. This requirement applies nationwide, both at the labor office (State) and (Central). Please confirm whether your company's area of operation falls under the central zone or state zone authorities.

Form No. XXIV - Half-Yearly Return by Contractor

The above return is required under the rule in the central region. However, under the Maharashtra rule, I believe this rule has been omitted. Please confirm whether it is required or not required for Maharashtra.

Can anyone help me out with the calculation for the number of days during the half-year on which (a) the establishment of the principal employer had worked and (b) the Contractor's Establishment has worked? I want to know, in a 6-month period ending June 13, the number of days is 181. How many days should be taken, and should offs and government holidays be deducted while calculating? Please help me.

My question is whether I have to furnish deductions from wages for the contributions made for PF, ESIC, P Tax, and Labour Welfare Fund at the time of declaration of Form XXIV. Alternatively, do I need to show deductions in respect to the CLRA Act, such as fines, damages, etc.?

Please advise.

Dear Soubhik,

As per the CLRA Act, you need to show the deductions if they are done as fines, damages/losses, and not the statutory deductions. These deductions should be deposited with the Labour Office.
