Employee Poaching Dilemma: How Should Employers Respond During Notice Periods?

Hi, I have a few questions:

1. If a current employee is poaching colleagues for another organization, what action can an employer take?
2. If the employee who is poaching has resigned and is currently serving their notice period, what action can an employer take?
3. Is there a time limit within which the action has to be taken?

This relates to a problem of retention. If your firm has better facilities in terms of packages, compensation, welfare, and other benefits, and a good corporate culture, I don't think any amount of poaching can knock your employees out. Please do not look for problems in others; try to understand the circumstances why people resign and leave you.

You can call off his duty and inform him that after giving the notice period pay, he does not need to come to the office. Of course, this is assuming he is not involved in any projects.

Regarding taking action against the person poaching others, you need to understand that if he is on a notice period, give him a written warning stating that his notice period will be curtailed and converted into immediate termination without the relieving letter as he is found to be in breach towards the company.

Proper Process for Employee Removal

Secondly, it is advised that you follow a proper process for the removal of an employee so that he/she is fully and positively neutralized and free of any grudge against the company. If he/she is resigning on their own, have an exit interview to understand the cause of resignation and any grievances. Try to address these issues so that the employee leaves with a pleasant experience.
