Employer Responsibilities for Accidents and Illnesses Outside ESI Coverage – Need Guidance

Dear Seniors, I am working in a food company which is outside the ESI coverage area. Please guide me on what the responsibilities of the employer are as per rules and on humanitarian grounds when an employee meets with an accident in the factory or falls ill. Please suggest.

The Workmen's Compensation Act is applicable if the ESI does not provide coverage. According to this Act, if personal injury is caused to a workman by an accident arising out of and in the course of his employment, his employer shall be liable to pay compensation.

If there is no coverage under ESI, then you can proceed with the Workmen's Compensation Act of 1923. If you need any further assistance, please let us know.

Kindly confirm if the industry located in Chikkaballapur District needs to pay ESI to its employees. Looking forward to your response.

You can also cover your employees under a Group Personal Accident Policy either inside the factory or with any national insurance companies to receive leave wages, death insurance coverage, and partial payment of medical bills.
