Facing Legal Trouble with My Ex-Company: How Can I Survive Without Salary or Settlement?

My ex-company has filed a case against me. I am accused under IPC sections 408 and 420. The company has neither relieved me nor initiated any settlement. This situation has made my life miserable. I am unable to secure a new job or receive any salary. Please provide me with some suggestions as I am desperate.

You have written about the charges that the company has filed against you. But why has the company filed those charges? Talk to your lawyer and find out whether you are eligible for a subsistence allowance.

If the company has terminated your employment following the rules and also filed a case of cheating against you, it is unlikely they will give you a subsistence allowance. The company would take such a step as above of filing a criminal case; it is a serious matter, and the company intends to get you punished. You better find another job.

Dear friend, you didn't mention whether you are suspended or terminated, but only said they have not relieved you. Does this mean you are still attending to duty? If so, you have every right to claim your salary. If they are still not paying you, you can claim it through an ALC or advocate. Since you mentioned you are A3, it appears you are not the main accused. Your advocate will help you understand how to get your salary without a break during the pendency of the case, as you are still not terminated or suspended.

Is there any Domestic Inquiry instituted and pending?

Thanks, sir, they have not suspended or terminated me, nor have they relieved me, and I am not going to the office. They have taken my resignation letter and filed the case. Now, for the past 7 months, I don't have a job, no income, and I have attended approximately 40 interviews receiving negative responses. Due to this reference from the X company, I am not finding a job. Now, my family is in the middle of a crisis; I don't have anything to say. Moreover, I have to pay the lawyer's fee, and daily life is also becoming challenging. I am looking for any chance where I can get my settlement, basic salary, or any allowance I can claim from the X company. Please suggest if there is any law that supports this.

Since you have submitted your resignation letter, you may have a better chance of receiving your salary, etc. However, your PF and gratuity are secure. Despite this, they have not officially relieved you or communicated the status of your resignation, whether it has been accepted or not. Have they informed you not to report to duty? If it was oral, you should insist on written communication. Until then, you should consider yourself still employed. You can pursue this matter through your advocate and also explore options through your ALC.
