Should We Register Our Small Offices in Haryana Under the Shop & Establishment Act?

We have offices in Gurgaon and Faridabad. The employee strength in Gurgaon is 8, and in Faridabad, it is 5. Should we register under the Shop & Establishment Act in Haryana?

It is applicable in all of Haryana. You are required to register and obtain only a single registration.

In my opinion, compliances and payroll processes can be managed from your Gurgaon office. However, you need to handle compliances on an area-by-area basis where your different offices are located. The inspector of a specific area will request records only for that particular area where your office is situated. For instance, the Shops Inspector in Gurgaon does not have the authority to demand records from your Faridabad office, even if you are maintaining them at your Gurgaon Head Office.

You are required to apply for registration under the Punjab Shops & Commercial Establishments Act, 1958, as applicable to the state of Haryana, within 30 days of starting your business. The Area Labour Inspector is the registering officer for this work. As you are employing only three workers, you are covered under this Act. The Municipal Corporation (Gurgaon) is empowered to issue a trade license, for which you need to approach this office.
