Completion Certificate / No Dues From Regional Labour Commissioner

How could we get the work completion certificate from the regional Labour Commissioner and with which form under the CLRA Act? After completion of the contract, by which form under the CLRA Act can we get the completion certificate or a no dues certificate?

Dear Rajiv Singh,

There is no need to get the Work Completion Certificate from the Regional Labour Commissioner. You must obtain the Completion Certificate from the Principal employer in Form VI-A, and you have to prepare the Completion Certificate in Form VI-B. Then submit the same to the Labour Commissioner to get the Labour Licence cancelled and get the Labour Security Deposit back. For this, you must submit the Original Labour Licence and a Xerox copy of the Security Deposit Challan.

You will get the Security deposit back. If you are starting some other work in the same area, the amount can be adjusted for the new project as well.

Actually, it is simply obtaining a no-dues certificate or claim for the completed project from the relevant labor authority for the said project. It is stated in our contract agreement that upon the release of the bank guarantee, we are required to submit certain documents related to the project's completion as well as a no-dues certificate from the labor department.

Continuing the above post, I would like to know who will issue the No Due Certificate in case we, as a contractor, want to apply for Labour License cancellation.

Dear Rajiv,

Normally, the Bank Guarantee is not related to the Labour Department. The client must provide you with the Completion Certificate. Only with that certificate can you claim the Bank Guarantee and the Labour Licence Security Deposit.

It's okay to say and it's a fact as well that while releasing a bank guarantee, no dues from the labor department are nowhere concerned. However, if it is mentioned in your contract agreement that you have to provide the same from the labor department while releasing the BG, as I mentioned earlier in my thread. Getting a completion certificate from the principal employer after project completion and claiming the security deposit from the labor department is general awareness, but why this matter is in such circumstances is only because the same clause is mentioned in our contract agreement.

Now, Bhaskar Sir, could you please guide me on how to resolve this situation related to the mentioned clause?

Normally, the Labour Department will not issue any no-due certificate. In fact, the Labour Department will have to provide it to you. Therefore, you should apply for the labor license security deposit and obtain the acknowledgment. Next, submit a copy of the same to your bank to release the Bank Guarantee.
