How Should We Compensate an Employee's Family After a Workplace Accident?

One of our employees met with an accident during the course of employment and passed away in the hospital. He was not covered under ESIC. Could you please guide me on how to compensate his dependents? He was 33 years old and was drawing a gross salary of Rs. 16,000 per month. Additionally, we had insured him under a Workers' Compensation Policy.

Instructions for Compensation Claim

Please follow the instructions provided by Mr. R N Khola. Additionally, contact the next of kin/nominee. Instruct the nominee to submit the following details:

1. Age/DOB proof of the deceased
2. Nominee/family details
3. Bank A/C details of the legally wedded wife and two children (if children are not available, then dependent parents)
4. Four passport photographs of each dependent
5. Next of Kin/Legal Heir Certificate
6. FIR copy
7. Inquest Report/Panch Nama
8. Death certificate (if the original is not available, it must be notarized)

You can claim the compensation paid to the family through the Labour Court, as well as the medical expenses incurred for his treatment. Ensure to attach the acknowledgment given by the Labour Court/Workmen Compensation Commissioner and all original hospital documents.
