Facing Months of Unpaid Salaries: How Can I Secure My Dues Without a Response?

I have resigned from the company since we have not been paid for 4 months, and for some people, more than 6 months due to the non-availability of funds. We were promised every time that it would be settled in a day or two without any concrete answer. Kindly suggest what I should do to get my dues, apart from mailing or talking, since I know that there will not be any reply from their end.

Send a lawyer's notice and consult an employment lawyer; they will have good knowledge on that.

Steps to Recover Unpaid Salary

First Step:

Send your employer a formal letter requesting the release of your unpaid salary and asking for a tentative date for settling your unpaid dues (F & F).

Second Step:

If there is no response, send another letter to your employer referencing your first letter and CC it to the ALC office.

Third Step:

If there is still no reply from the employer, directly approach the ALC with your previous and last letters, along with some of your employment details (appointment letter, joining letter, ID card, attendance sheet, etc.).

The above channel for communication will serve as strong evidence and be more favorable for you.

As advised by Mr. Amit, please create all your documents first and proceed further. In the first letter, do not forget to mention that they have asked you to submit the resignation letter and, as per their instruction, you have submitted the resignation letter. However, to date, you have not received the last month's salary as well as the F&F Settlement. Kindly request them to clear your dues without further delay.

Please send the letter to the employer through Registered Post with AD only. At least you can have the acknowledgment copy of your letter received.
