Dear Harish, As you are aware, the PF account cannot be claimed by the company. Therefore, unless you settle your account with your pending dues, how can the gratuity be released by the company? They can forfeit the gratuity on charges of fraud.

It is advisable to clear your dues and then proceed with the gratuity claim; otherwise, you may face legal action in court.
