How Would You Minimize Lawsuits as an HR Manager in a Non-Union Company?

MrHabbey
I'm a student from the University of Lagos. My discipline is Industrial Relations and Personnel Management (IRPM). Here, I have a challenge with this subject matter and your view will be required.

Case Study

XYZ company is a non-union employer that has experienced an increasing number of employment lawsuits and employment-related charges for the past 10 years. Many of these actions have required the company to spend millions of naira in legal fees for its defense and additional money to resolve the actions. You, as the Human Resource Manager, are required to assess ways to minimize the number of lawsuits and charges filed against the company and thereby minimize the costs associated with court actions.

Please, I need to submit this subject matter a few days from now. Your view is humbly required.

Thanks...

The statement that the employer is facing an increasing number of employment lawsuits and employment-related charges indicates that the employer is not following any employment laws. The statement that the employer had paid additional monies to resolve the action indicates that he had not corrected himself even after facing situations which had made him pay for his actions.

Recommendations for Compliance and Risk Management

First recommendation will be to advise the employer to comply with the provisions of the employment laws. The second recommendation will be to undertake a review of all the pending employment-related lawsuits and, if possible, settle the issues out of court wherever it is found that the employer had taken wrong decisions or acted contrary to law and there is no chance of success. This would minimize the additional monies to be paid and will also save legal fees.

The third recommendation will be to thoroughly scrutinize all actions relating to employment to ensure that there is strict compliance with the laws of the land.
