Hi,
we want to outsource of 26 employees to one consultancy firm, i have a doubt
1) whether that consultancy also comes under contart lobor act?
2) if not then which docs we have to collect from them?

Really very good posts introduced new consultancy firms. But there is no proper answer from these posts. Whether the pay has to go to them? If yes will they pay their pay and esi and other benefits? Can we deduct tds from them? Are they ready to submit the forms? These are all the questions asked by mr. Bhaskar.

Dear all
1) The Consultancy also will come under labour act.
2) For any firm it is mandatory that they should ensure all legal compliance s. So when you are
outsourcing you can ask for the related registration copies like PF,ESI etc
3) Also get the PF A/c of your contract employees
4) Get the ESI Cards for contract employees wherever it applies
5) Service Tax Registration is applicable
6) Make a clause in the contract that they should submit copies of payment challans for PF and
ESI on monthly basis.

List of documents to be submitted by the Contractors



1. Copy of work Order issued to the Contractors

2. Copy of PF Code Allotment Letter

3. Attendance / Wage Sheets for all the months duly signed by the Contactor as well as Site In-charge

4. Copy of Invoice submitted by the Contractors

5. Copy of PF Challans on monthly basis . No. of employees shown in the challan should tally with the wages Sheet of each

month. If PF is paid for more than one location then Site wise Summery for all the months should be submitted.

6. Copy of Monthly PF Return ( 12A , 5 / 10) duly acknowledged by PF Authority.

7. Copy of ESIC Challans. No. of employees shown in the challan should tally with the wages Sheet of each

month. If PF is paid for more than one location then Site wise Summery for all the months should be submitted

8. Copy of Pro Tax Challans

9. Original Indemnity Bond on Rs 200/- Stamp paper as per format attached herewith duly notorised two years once

10. Undertaking on Contractor Letter Head as per the format enclosed herewith.

11 Payment made for LWF for the above period

if anything missed not proper there anything goes wrong the principal employer liable to pay any damages
