Gujarat High Court Judgment on Part-Time Employees

I am attaching an interesting judgment delivered by the Gujarat High Court in which the court has held that a part-time employee is not excluded from the definition of 'workman' under the Industrial Disputes Act. Accordingly, he could also enjoy the benefits applicable to a workman. Whether he is a workman or not is a mixed question of law and fact. It indirectly also accepts the concept of dual employment at the same time.

In CASE NO Appeal (civil) 7986 of 2004, in which the PETITIONER is the General Manager of Indian Overseas Bank, and the RESPONDENT was the Workmen, All India Overseas Bank Employees Union, the Honourable Supreme Court of India, in its judgment dated 10/03/2006, held that part-time gold appraisers are workmen as defined under the Industrial Disputes Act, 1947. The Bench which decided the issue consisted of their Lordships ARIJIT PASAYAT & ARUN KUMAR. The judgment is available on the website of the Honourable Supreme Court of India.
