Resigned Without Notice During Probation: How Should I Handle HR's Legal Threats?

I have resigned from a company without serving the notice period during the probation period due to family reasons. I have already sent an email to my manager regarding my resignation.

Today, I received an email from HR with the subject line: Your resignation via email dated 28-Jan-12.

We have received your resignation via email. We would like to point out that you did not provide the proper notice as per the terms of the employment letter from the company. Additionally, you have not completed the handover of responsibilities as of today. We have been trying to contact you on your mobile number [Phone Number Removed For Privacy Reasons], but you have not responded to our calls. This neglect of duty is not acceptable. The company has incurred losses due to your sudden departure. You are hereby informed that the company will take all necessary actions against you, including legal measures, to safeguard its interests if you do not respond to this letter within 5 days from its date of service.

Please advise me on how to proceed.

First of all, you have to accept that you have carried out a wrong practice while leaving your organization. Now, in case the HR has replied to you, I suggest that you reply to them with your concerns about leaving. If you do not reply to your HR within the stipulated time, necessary legal action can be taken against you.

Importance of Responding to HR Feedback

It is good etiquette to reply to HR with your feedback when leaving a company. In case you do not reply, the following are the consequences:

1. Your reputation in the company will not be good, and this may further hamper your relations with the new employer when your new employer conducts a reference check with your previous organization.

2. There can be a case filed against you in the labor court.
