Notification on Maharashtra Shops & Establishments Rules Amendment

I am attaching a notification dated 3.1.2012 issued by the Government of Maharashtra amending the Maharashtra Shops & Establishments Rules. The amendment provides for online submission of applications for registration, renewal of Registration Certificates, exemptions, returns, and any other applications.

Amendment Provisions

The amendment provides for the following:

1) All applications under the Act will have to be made electronically, and fees will have to be paid electronically.

2) A notice stating "No child labourers are engaged" will have to be displayed on the notice board.

3) The application for registration (Form A) and renewal of registration (Form B) have been revised, and detailed information has been prescribed.

4) A monthly return has been prescribed for the first time in Form AA. However, submission of monthly returns shall be:
- Monthly in case of more than 50 employees
- At the end of the quarter in case of 21 to 50 employees
- At the end of six months in case of 11 to 20 employees
- At the end of the year in case of up to 10 employees.

It is necessary for all establishments to read the whole of Form B in advance so that they will be prepared for applying for renewal in December 2012. The reason is every establishment, especially small ones, may not have the infrastructure/data asked for in Form B.
