MLWF Act Applicability for Different Roles

Though the application of the MLWF Act is for employees below supervisors and not above supervisors, I am working as an HR executive. The function of the company involves designing on CAD, purchase-sales department, HR, finance, and it is registered under the Bombay Shops and Establishment Act.

As I understand, it is important to comprehend the definition of an employee and their function/role from the job description to decide applicability and salary. Is the said act applicable to my company where employees are working as:

- Senior Design Engineer
- Senior Product Engineer
- Senior Engineer Design
- Senior Designer
- Trainee
- Trainee Engineer
- Executive Purchasing
- Executive HR and Admin

We have a team and a team leader for those who are working on projects. I believe that team members are monitored and supervised by the team leader as a supervisor, so they (team members) are eligible for contribution to MLWF.

I am seeking clarity on my opinion as we (the company) are not currently making payments under the said act.

Please advise me on the issue of whether Trainee Workers are covered under the Maharashtra Labour Welfare Fund (MLWF) or not. Please reply urgently.

Thanks.

Ajay
