Availing leave is a primary privilege for the employee. If the employee takes leave during the notice period, it should be approved by the relevant authority. Once the leave is approved, there will be no issues regarding it.

Notice Period Leave Policy

During the notice period, no one can take leave. However, you have to pay all leave benefits to that person in his/her Full and Final settlement.

According to the company, you are not allowed to avail leaves during your notice period. However, some companies provide a leave encashment policy. Through this policy, you can receive a certain amount in exchange for your unused leaves.

Employee Leave During Notice Period

Availing leave is a privilege of the employee, and labor laws support this right. In the case of the notice period, it is solely at the discretion of the management to consider leave days within the notice period or extend the notice period for such leave days. Normally, in practice, we consider the employee's genuine leave days.

Firstly, it purely depends on the policy of the organization, which is documented and shared with the employees regarding what the policy states.

Leaves are required urgently, irrespective of whether one has leaves or not in their account. Leaves should not be utilized just for the sake of it or because they are getting lapsed.

Important Considerations

There are a couple of things that might need to be noted:

If one is not allowed to take leaves during the notice period, it doesn't mean that they cannot take leave and have to come to work. What if they are unwell and not in a position to bring some productivity? However, for the number of days of leave taken, the same number of days of notice can be extended.

If leaves are calculated on a calendar year basis and there are some leaves that are getting lapsed while the employee is in the notice period, the organization should consider this as an exception and get the leaves paid as encashment along with F&F to avoid loopholes (Planned Sick Leaves/Create Emergency).

Addressing Ruchi's Question

Coming back to Ruchi's question: Can an employee serving a notice period avail leave? Go through the organization's policy. If it doesn't exist and you need a logical answer, then my answer is yes, one can take leave during the notice period.

I feel the issue of leave varies from institution to institution. I say so because in my institution, we have a policy on leave which states that no one accumulates more than 15 days at the end of the year. In this case, if there is a notice of separation, it is advised to plan your handover and exhaust your leave days before your last day. This has helped our institution from spending too much money on such packages. I hope it helps.

Notice Period and Leave Utilization

The notice period is important for completing backlog work, addressing pending issues, and ensuring a smooth transition for the successor. There is no rule prohibiting the utilization of leave during the notice period; it can be taken with the approval of the Head of Department (HOD).

Leave Policy During Notice Period

If the employee has the manager's approval, he can avail of leaves. However, any leave taken during the notice period automatically becomes a PL (Paid Leave). This needs to be accounted for while calculating the encashment of PLs during F&F (Full and Final settlement).

One day of leave can be permitted per month during the service of the notice period. More leave can be given if the company has a policy on it. Generally, obtaining leave during the service of the notice period is not allowed.

He/She can take leave irrespective of giving resignation. Taking leave for personal or sick reasons is the right of the employee if he/she has leave in his/her account. However, to maintain a good relationship with the company, he/she should ensure that the work he/she is doing at that time will not suffer at any cost.

Leave During Notice Period

No rule bans the granting of leave to an employee during the notice period for resignation. Arbitrary rules should not be followed without any logic. Leave due can be granted to the employee during the notice period unless there is an extreme exigency of service. Furthermore, it is subject to the condition that the leave period should not extend beyond the due date of relief on resignation.

Leave Policy During Notice Period

Normally, as per the service rules, no leave can be availed during the notice period. However, it depends upon the contract of employment, especially in the case of private companies. In the case of all government and PSU jobs, no leave can be availed during the notice period. Still, if you take leave, the notice period gets extended by that much leave period. For example, if you have given one month's notice on 25th Nov. and if you take 4 days of leave (of any kind), then the last date of employment will be 29th Dec (and not 25th Dec).

Special Leaves During Notice Period

Further, there are special leaves which are preparatory to retirement (LPR - Leave Preparatory to Retirement). Such kinds of leave (combined with any other kinds of leave such as CL, PL, etc.) can be availed during the notice period.

Yes, the undersigned totally agrees with Mahavirsingh. However, the question remains: do we need to worry about his/her balance leave? No SL or CL shall convert into encashment, only PL. It also depends on the company policy for the encashment of maximum leave (PL).

Except for sick leave, the resigned individual cannot avail other leaves, namely CL/EL. Most companies have a policy of EL encashment.

If an employee has given a notice period, let's say one month (depending on the organization's policy), the employee is not allowed to take leave.

Different companies will have their own leave policy. In my company, an employee serving the notice period will not be eligible for leave apart from regular weekly offs.

Leave Policy During Notice Period

If the company does not pay for the leave remaining in the Full and Final settlement (F&F), then the individual is not allowed to take leave during the notice period. Additionally, if the individual has a significant number of paid leave days remaining, they are also not entitled to take leave during the notice period.
