Is an Employee on Maternity Leave Eligible for LTA if They Resign Without Notice?

Query Regarding LTA Eligibility

My query regarding LTA is as follows:

Our company considers LTA payment from April to March. An employee goes on maternity leave from April to July and does not return after the completion of 3 months. The company pays her salary for July and August. She resigns on 14th October but does not serve the notice period. In fact, she hasn't served the company in the current financial year. Is she eligible for LTA? How would the pro-rata calculation of LTA be worked out?

Need a reply ASAP, please.

If the employee has been confirmed with the company, then you will have to pay on a pro-rata basis. The calculation is as follows: Annual LTA/12 X number of months in service for that financial year.

Also, if the employee has not served the notice period, you can deduct the salary in lieu of the notice period while doing the full and final settlement.

I have a doubt regarding whether an employee is eligible if he/she has not attended work for the entire financial year.

If the salary is paid in that financial year, kindly refer to Trishna's query: Leave was adjusted, and there was no loss of pay. Salary from April till August is paid to the employee, so the employee is eligible for LTA.
