A person is on maternity leave. What are the rules for Earned Leave (EL) calculation?

Dear Member,

Welcome to CiteHR. Under which Act & Rules are you calculating earned leaves? If your unit is covered under the Factories Act, 1948, then you can count maternity leaves for any number of days not exceeding twelve weeks for eligibility purposes, but the woman employee will not get EL for these days. Thus, we are not to calculate EL on these maternity leaves.

I am sure she is also eligible for her earned leave. Whatever the reason, she is eligible to take it into account.

Dear Sir, As you already mentioned, a person is on maternity leave. Maternity leave is provided to anyone during pregnancy, duly certified by the medical officer, and it is for a certain period. The employer has to pay the full salary to the employee during maternity leave.

Secondly, if she is already enjoying the leave benefit of one, how can she be eligible for EL/PL? Otherwise, if there is completion of maternity leave and she wants to extend the same, she must approach her doctor for an extension of the same, and the benefits which remain will be the same.

You have to refer to the Shops & Commercial Establishments Act/Factories Act as applicable to your company to determine whether the period of maternity leave is eligible for the leave provided under the applicable laws, i.e., the Shops & Commercial Establishments Act/Factories Act.
