Validity of Model Standing Orders

The validity of model standing orders is six months. Thereafter, you must have your own standing orders and get them certified by an officer not below the rank of Deputy Labour Commissioner. Attached is a draft of the standing orders that can be modified according to your requirements.

Understanding Standing Orders in Companies

Each company obviously has its own set of standing orders. The rules and clauses to be included in the standing orders depend on the company's policy and must also be acceptable to the employees. If the company has a trade union, a draft copy should be provided to the union for their approval, and the trade union representatives will sign the standing orders. In cases where the company does not have a trade union, the certifying authority will choose a few employee representatives, and certification will only be granted after obtaining their agreement. This ensures that the clauses reflect the employees' consent and not just a one-sided decision. Therefore, depending on the employees' behavior and the industry's nature, standing orders will vary from one company to another.

Thank you very much for your message. I have some remaining confusion. Is it possible for a company to run successfully without a standing order? If a company has its own standing order as part of its company policy, my question is whether the standing order is authorized by the Labour Commissioner or only by the Managing Director of the company. I would appreciate it if you could advise me on this matter, considering not only manufacturing concerns but also project-based companies.

I think I have made it clear that a Standing Order is mandatory for establishments covered by the Industrial Employment (Standing Orders) Act. Similarly, it is not one-sided, but it should be accepted by the employees and then certified by the Labor Department. That means it is not something that can be decided only by the MD or owner of the company but should be mutually accepted by both the employer and the employees.

There are no industry-specific standing orders. You can follow the Model Standing Orders provided under the Industrial Employment Standing Orders Act. If you wish to make any changes consistent with the Standing Orders Act, you may do so, but you will need certification from the authority, i.e., the Additional Commissioner of Labour, following the prescribed procedure.

In one of the factories, there are no company employees. Only contract laborers are working. In this situation, do we have standing orders? It involves agreement management and contract employees. Is it possible?

Dear Member,

In my opinion, if your unit is covered under the factory as defined under the Factories Act, 1948, and you do not have a factory license, even then you are required to have certified standing orders after six months. Please note that you are employing 100 workmen.
