Confused About Overtime Hours in Tamil Nadu? Let's Clarify the Real Numbers Together

SARASWATHI GOPAKUMAR
I would like to inquire about the overtime hours per month and quarter in Tamil Nadu. There seems to be a discrepancy in the information provided by social auditors, with varying figures such as 60 hours, 70 hours, etc., being reported. Could you please clarify the exact number of hours for overtime? I would appreciate a prompt response.

As per the Factories Act 1948 and the Tamil Nadu Factories Rules 1950, no adult worker shall be required to work in a factory for more than 48 hours in a week or more than 9 hours in a day. An application shall be made at least 15 days prior to the engagement of workers for overtime work. Exemptions will be granted after scrutiny and perusal of the documents. Exemptions will be granted for a quarter at a time, starting with January, April, July, and October. The exemption granted restricts the overtime hours to 75 hours in a quarter, in addition to other conditions mentioned in the exemption order. Please note that the Act prohibits the granting of overtime exemption in respect of women workers.

Maximum working hours: 10 hours in a day including ½ an hour interval; 54 hours in a week

Maximum working hours including O.T.: Shall not exceed 60

Explanation: 'Quarter' means a period of three consecutive months beginning on the 1st of January, the 1st of April, the 1st of July, or the 1st of October.

Wages: For the purposes of sub-section (1), "ordinary rate of wages" means the basic wages plus such allowances, including the cash equivalent of the advantage accruing through the concessional sale to workers of food grains and other articles, as the worker is for the time being entitled to, but does not include a bonus and wages for overtime work.

For more clarity, please let me know, and I will inform you. Those holding positions of supervisory and management will not fall within the purview of these sections.
