Hospital Industry Regulations: Does It Fall Under the Factories Act or Shop & Commercial Act?

I wanted to know under which act the hospital industry falls. Does it fall under the Factories Act or the Shop & Commercial Act?

The hospital is already registered under the Societies Act of 1860.

Dear Rekha, why do you require the above-mentioned information? Generally, hospitals are registered under shops and commercial establishments, and in some cases, they may come under the Factories Act, for which we need to check the definition. If you have a blood bank, radiation equipment, canteen, biomedical waste, general waste, and others as applicable by the state, then you have to register. Since 2010, hospitals have been covered under ESI. For any updates, please revert to us.

As already mentioned by members, in general, hospitals are covered under the Shops & Establishment Act. However, to finalize the query, you must refer to your State Shops & Establishment Act and the definition of the manufacturing process under the Factories Act, 1948, as well as the applicability clause under both of these Acts.
