Understanding Leave Policies: Is Sunday Unpaid if Absent on Saturday or Monday?

My name is Mrunal, and I am handling HR for an IT company. Could you please assist me with the following query: if an employee is absent on Saturday, will their Sunday also be unpaid? Similarly, if the employee is absent on Monday, will their Sunday be unpaid as well? Additionally, do we have proper legal considerations for these scenarios? Your urgent response would be greatly appreciated.

Labor Law Perspective on Paid Holidays

From the labor law perspective, all Sundays are paid holidays in the month, and hence salary could not be deducted by the employer. Though most companies follow such rules/policies, which appears inappropriate. It is up to the employer to frame a genuine leave policy.

Sunday Wages and Leave Policies for Laborers

For laborers, as per the Factories Act, Sunday wages will be considered after 48 hours of working in a week (excluding overtime). In many establishments, Sunday is not considered as leave if they were on leave on either Monday or Saturday. However, if they take leave on both Saturday and Monday, the intervening Sunday will be treated as leave. This policy varies depending on the leave policies of the establishments.

If the organization is covered under the Shops and Miscellaneous Establishments Act, it doesn't matter.

You need to go through the Shops and Establishment Act of that state. You will get to know about leaves and other regulations as well.
