New to HR in Construction: What Should I Know About Site-Specific Roles and Responsibilities?

Hello friends, this is my first thread after joining my first job. I was a student until now, but nowadays I am in a learning period. I aim to not only share my thoughts with you but also to gain a lot of knowledge from you. By doing so, I believe I can achieve the best in my life.

I have recently joined a construction company for my first job. This is why I am eager to understand the various functions (roles and responsibilities) of HR such as administration, training and development, industrial relations, provident fund (PF), travel allowance (TA), daily allowance (DA), labor laws, and more, especially at project site locations.

Please provide information on the subjects mentioned above.

Registration of Temporary Office Under the Shop and Establishment Act

Is it necessary to register a temporary office under the Shop and Establishment Act if it is open for 2-3 years within the construction industry to have control over the project?

Dear Abhijeet Kumar,

The temporary offices constructed to manage construction activities are not required to be registered under the Shop and Establishment Act. However, the Principal Employer must register themselves as an establishment under the Contract Labour Act, and the Contractor needs to obtain the Contract Labour License to conduct construction activities on the premises. Additionally, you must also register under the Building and Other Construction Workers (BOCW) Act.

As regards the registration of site offices of contractors, PMC, and the principal employer, I would like to share my experience.

One of the Inspectors asked me where it is written that the offices at construction sites are exempted from registration under S&E. This issue was resolved when I questioned him on how many such establishments at construction sites are registered with him within his area.

Chapter II Section 7 deals with the registration of establishments, which runs as follows:

7. Registration of establishments.

(1) Within the period specified in sub-section (4), the employer of every establishment shall send to the Inspector of the local area concerned a statement, in a prescribed form, together with such fees as may be prescribed, containing:

(a) the name of the employer and the manager, if any;
(b) the postal address of the establishment;
(c) the name, if any, of the establishment;
(d) the category of the establishment, i.e., whether it is a shop, commercial establishment, residential hotel, restaurant, eating house, theatre, or other place of public amusement or entertainment; and
(e) such other particulars as may be prescribed.

(2) On receipt of the statement and the fees, the Inspector shall, on being satisfied about the correctness of the statement, register the establishment in the register of establishments in such manner as may be prescribed and shall issue, in a prescribed form, a registration certificate to the employer. The registration certificate shall be prominently displayed at the establishment.

My humble request to beginners is that they should read the law very carefully and minutely, interpret the same, go through the case laws, amendments, and notes to the laws, and apply the test of reasonableness.
