Anyone engaged as per Contract Labour (R&A) Act 1970, is eligible for the following compension at the time of Full and Final Settlement, while retrenching or while terminating as per Industrial Dispute Act, 1947.

Conditions precedent to retrenchment of workmen.

Notice Pay

25F. No workman employed in any industry who has been in continuous service for not less than one year under an employer shall be retrenched by that employer until—
(a) the workman has been given one month's notice in writing indicating the reasons for retrenchment and the period of notice has expired, or the workman has been paid in lieu of such notice, wages for the period of the notice;

(a) 1 day notice pay if worked less than 30 days,
(b) 3 days notice pay if worked above 30 days but less than 240 days
(c) 26 days notice pay if worked 240 days and above (as a matter of fact 1 month notice pay he is eligible for. But we are calculating the daily minimum wages by dividing the wages per month fixed by the government by 26 days. This is because the weekly off also be made as paid off. (Total days in one year 365; total weeks 52; Hence 52 paid weekly off; 365-52=313, the per year working days are 313 days then per month working days will be 313/12=26.08 days and in rounding off it will be 26 days per month) Hence 26 days notice pay will be paid.

Retrenchment Compensation

25F (b) the workman has been paid, at the time of retrenchment, compensation which shall be equivalent to fifteen days' average pay [for every completed year of continuous service] or any part thereof in excess of six months;
and

Whoever worked for more than 1 year service will be eligible for 15 days wages as Retrenchment compensation and in any part thereof in excess to 1 year service more than 6 months service will be paid additional 15 days wages.

Leave Pay

All the workmen will be paid with 1 day wages for every 20 days worked.

Gratuity

Please refer Payment of Gratuity Act.

In case if a person served for 245 days he will be eligible for 26 days notice pay and 12 days leave pay.

If a person worked for (554 days) 1 year 10 month then he will be eligible for 26 days notice pay, 30 days Retrenchment Compensation and 27 days leave Pay.

If a person worked for 1592 days (5 years 5 months) then he will be eligible for 26 days notice Pay, 75 days Retrenchment Compensation, 79 days Leave Pay and 75 days Gratuity.
