Please understand that Factories Act, 1948 is made for Factories involving in Manufacturing Process and BOCW Act, 1996 is made for Construction and Building work.
If Factories Act is applicable then BOCW will not be applicable, and if BOCW Act is applicable then Factories Act and Mines Act will not be applicable for them.
As a matter of fact, the BOCW Act is a baby act, for which the responsibility of inspection has been handed over to Factories Inspector and the Factories Inspector is the Registering Authority for BOCW Registration. As the Factories Act is the older one and the BOCW is new to them, always the factories inspector will deal as like factories inspector and not as BOCW inspector.
