I want to know if the Factory Act of 1948 comes under the Building and Other Construction Workers (BOCW) Act of 1996 or not.

Understanding the Applicability of the Factories Act and BOCW Act

Please understand that the Factories Act, 1948, is made for factories involved in the manufacturing process, and the BOCW Act, 1996, is made for construction and building work.

If the Factories Act is applicable, then the BOCW will not be applicable, and if the BOCW Act is applicable, then the Factories Act and Mines Act will not be applicable to them.

As a matter of fact, the BOCW Act is a newer act, for which the responsibility of inspection has been handed over to the Factories Inspector, who is also the Registering Authority for BOCW Registration. Since the Factories Act is older and the BOCW Act is new, the factories' inspector will always deal with it as a factories inspector and not as a BOCW inspector.
