Struggling to Get Form 16 After Resignation: Should I Report to the Tax Department?

Dear Sir, I resigned from the company on 10th March 2011. I have been continuously asking for the Form 16 as TDS has been deducted from my salary from May 2010 to February 2011. Under these circumstances, what steps should I take? Should I complain about this matter to someone in the income tax department? Please clarify for me.

As per Section 31 of the IT Act, every employer is bound to issue a TDS certificate in Form 16 to employees if any tax has been paid to the central government on behalf of the employee.

Dear [Employer's Name], I hope this message finds you well. I am writing to request the issuance of Form 16 as tax has been deducted at the source from my salary. Kindly provide the necessary documentation at your earliest convenience.

Additionally, I will also be sending a copy of this request to the Assistant Commissioner, Income Tax of our area for their reference.

Here, I would like to discuss with you regarding the matter of my company. I have resigned from the company, but the company's HR personnel are not clearing my dues. This is because one of my distributors is not issuing the no dues certificate due to personal issues with me. Consequently, the company is withholding my dues and not processing the Full and Final (F&F) settlement. It has been almost eight months since this issue arose, and despite my requests, the company's HR personnel have not attempted to contact the distributor directly.

I suspect that the company's HR personnel have formed a partnership with the distributor to withhold my dues, including two months' salary and other benefits. Given these circumstances, what should I do next? Should I consider taking legal action against the company?

As far as legal options are concerned, first, you should send a pleader's notice to your ex-employer for the recovery of the dues. Wait for their official reply. I am sure they will respond to the pleader's notice. If you don't receive any reply from them, then the last option is filing a case against them in civil court. However, try to avoid reaching this last option.
