Is It Fair for My Old Employer to Demand an Indemnity Bond for Late PF Withdrawal?

Smita.s
I am trying to withdraw my PF from my old company, which is in Bangalore. I left the company in 2005 and submitted the withdrawal form in 2010. Now the company is saying that I have to submit an Indemnity Bond because I am withdrawing the PF quite late (more than 3 years late). I am in Lucknow now and can't go to Bangalore for this.

Is it right on the part of the company to ask for an Indemnity Bond?

If the claim is submitted later than 1 year, then you have to submit an indemnity bond along with the PF claim forms (Form 10C and Form 19), PAN Card, Bank Passbook first page Xerox, and a relieving letter issued by the previous employer which will have the PF Number.

I am enclosing the PF Withdrawal Indemnity Form for your ready reference.

These procedures are applicable for claims exceeding one year.

Consider Transferring PF Amount

Why don't you consider transferring the amount to the new PF number if you are still employed?

Thanks a lot for sharing the information. I also want to understand whether I can get this Indemnity Bond signed by a Notary from my current location, which is Lucknow, since I can't go to Bangalore to get this done.

Thanks,
Smita

Indemnity Bond Notarization and PF Application Submission

The Indemnity Bond can be notarized from anywhere, and the PF Application can also be submitted to the Lucknow PF Office itself after obtaining attestation from the Nationalised Bank Manager where you hold your account and the first page of the passbook you have attached.

The Lucknow PF Office will further forward the same to the concerned PF Office, and it will be processed upon receipt of your application at the Bangalore PF Office.

Mr. Bhaskar, don't you think the employer needs to sign off and stamp the EPF form? Hence, it is mandatory to visit the office and complete the formalities. Moreover, submitting the form to the correct EPF office will save you from harassment and time wastage; otherwise, it might take as long as 3 months. The normal processing time is usually 1 month if the EPF form is submitted with all the necessary documents. Therefore, Smita, I suggest you spare some time to visit your previous employer and complete the formalities once and for all.

I lost my husband in an accident, and in order to claim his PF, the company requires an Indemnity Bond by the spouse. Can anyone share with me the format of the bond for PF withdrawal?

Thanks in advance,
Jose
