Should I Pay PF & ESI To Same Employee

Dear Experts,
Kindly guide me on above subject, as I am a labour contractor and one of my client asked me to pay both, PF and ESI to everyone is employed.

Dear Subhankar Shee,
Yes you can pay both PF and ESI for the same employee.
The criteria fixed for coverages are
PF- Rs.6500 basic or less than that
ESI- Rs.15000 total salary or less than that.

You can pay the ESI and PF and you can also claim the same from your employer by submiting the challans

You can make the ESI and PF in single pay sheet for all the workmen who are drawing less than Rs. 15000/- pm. (PF 12% in basic pay and ESI 1.75% in Gross Amount).

The PF basic fixed to Rs.6500/- is mainly for the purpose of EPS Rs.541/-, which is 8.33%. If the basic is more than Rs.6500/-, then from the Employer share Rs.541/- will be considered as EPS instead of 8.33% and balance amount will be deposited with Employer Share of PF instead of 3.67%.

The PF and ESI can be claimed from the employer, only if the claim clause is incorporated in the Letter of Indent/Work Order. If the contract value is fixed after considering the PF, ESI, PT, Service Tax & other charges then you cannot claim from the Principal Employer.

As an Employee can i question the Employer if the PF is not paid when my Basic is more than 6500/-

You may question the employer. But that depends upon the employer's interest and they may be showing the Employee records as CONSULTANTS / short term worker. In that case, the chances of PF payment maynot work. Thanks!
