How Can I Withdraw My PF Without Company HR's Help While Unemployed?

I am very confused with this situation. Please help me.

I am currently unemployed and studying a professional course. I worked at a company for only four months. My PF and ESI deductions were Rs. 924 and Rs. 254 per month. I visited the HR Department of my company and inquired about PF formalities. According to my company's HR, I cannot withdraw my PF as it requires a minimum of 6 months of employment with the company. Instead, they suggested transferring the PF. While I understand the option to transfer, I am in need of funds now due to my unemployment. I resigned from the company on March 1st, 2011. It has been almost 3 months since then. After further inquiry, I discovered that I am eligible to withdraw my PF. I prefer not to revisit my office and engage in a discussion with the HR team. I wish to proceed with the withdrawal process independently.

I possess my PF number, am aware of the PF office in the Bangalore region linked to my company's establishment code, and have my salary slips, joining letter, and a valid bank account number with a passbook.

My question is, how can I withdraw without the assistance of the company's HR, and what is the procedure? I have been unsuccessful in obtaining clear answers from those I have approached over the past week. Kindly assist.

Hi Kranti,

Once you leave the company, the employer has no right to stop your PF. They can refuse to sign the form or unnecessarily delay it for harassment, but the truth is they have no control over the PF.

What you should know:

There are measures that can be followed to get the amount transferred to your new account. When a member finds it difficult to get the form attested by the employer, they can get the attestation on Form 19 and 10C from any of the following officers and send it to the Provident Fund office:

- Manager of a bank
- Any gazetted officer
- Member of the Central Board of Trustees/Committee/Regional Committee (Employees' Provident Fund Organization)
- Magistrate/Post/Sub-Post Master/President of Village Panchayat/Notary Public

To add on to what Archna has conveyed, after you get the duly filled withdrawal forms attested, possibly submit the same directly to the PF Office and obtain the acknowledgment. Your previous employer has no right to stop you from getting the settlement amount.

Dear Kranti,

Please fill Form 10C and Form 19 (with pre-receipted sign on Revenue stamp). Attach your payslip copy to confirm your PF Number and establishment code, a cancelled cheque leaf or the first page of your passbook to confirm your SB account details, and a copy of your PAN Card.

Hand over the documents to your nearest PF Office or the PF Office where your previous employer is registered. The amount will be credited to your account within a 2-month period.

EPS Contribution and Transferability

The contribution towards EPS cannot be claimed as the member has worked only 4 months, but it can be transferred.

Dear Sir,

I believe we can claim the PF amount even if the employee has worked for only 4 months. He will not receive the employer's share, but he could receive his share at 12%.

Please correct me if I am wrong.

Dear Kranti,

The contribution towards EPS cannot be claimed, but you will only receive the EPF contribution at 12%. So, please fill out Form 19 and ask your employer to attest to this form before submitting it to the PF office.

I am accepting all the above superiors' suggestions. Hi, kranti_ratho, nobody can stop your PF. Out of 24% (12+12), you can withdraw only 15.67% (24-8.33) only. You cannot get the pension fund (8.33%). It is better to meet the PF office and take suggestions on it.

I will withdraw myself with attestation of a gazetted officer's signature and all the relevant documents, as well as fill out forms 19 and 10c. Once again, a lot of thanks to all of you for replying to my query. Whatever the amount, it is my money, and though small, it will be helpful to me as I am currently unemployed.

Hi Kranti,

Everyone has given the right explanation. No one can stop the withdrawal of PF. Just fill out the required form and get it signed by the concerned authority. You can withdraw only the PF contribution if the service is less than 6 months. You cannot withdraw the pension fund amount, i.e., 8.33%. If the concerned authority denies to sign your form, then you can get a signature from the authority mentioned by Archna.

Hi Kranti,

You can submit Form 19 (for EPF withdrawal) duly attested by the employer and deposit the same at the nearest EPFO office. The amount of family pension can't be withdrawn if your service is less than 6 months.

In the future, if you join another company, you can transfer the Family Pension account to the new account with your present employer by submitting Form 13. This form should indicate the PF Account Number with the previous employer, along with their company name, address, and the date of leaving the service. The amount will be transferred to your new employer's given PF account number.

Dear Kranti,

When an associate has worked for less than 6 months of service, they are eligible to withdraw their PF. You only need to submit PF Form No. 19. Form No. 10C will be rejected by the department due to not having 6 months of service. I have submitted a number of forms like this, and all individuals have received their PF. You will also receive yours.

In the case of ESIC, you can utilize ESIC services for up to 6 months, that is until September 2011 if you resigned after April 2011.
