How Much Notice Should Be Given for Termination During a Probationary Period?

Hi All, In our company, the employee probationary period is 3 months. If the company wishes to terminate an employee during the probationary period, how many days in advance should the management inform the employee about the termination? Could you please clarify my doubt?

In that case, the company has to give him/her 30 days of notice of termination or else one month's salary.

Clause for Appointment Letter

You should enter the following clause in your appointment letter:
You will initially be on probation for a period of six months from the date of your appointment. The management, however, reserves the right to terminate your services without assigning any reason whatsoever during the probationary period. In case you wish to leave the services of your own accord, during your probationary period or on its completion, the clause of serving notice of one month or salary in lieu will apply. However, during the probationary period, the management may terminate your services by giving a day's notice.

Hi Murli, there is no need to serve notice during the probation period. You may terminate him without giving any prior notice, but if the probation period is completed, you have to follow the employment contract.

What Vikash has said is absolutely true. When an employee is in the probation period, he/she does not need to serve a notice period. Even if the company terminates the employee or asks the employee to resign, the company can do so at any time during the probation period.

In the case of the notice period, if the employee resigns or the company asks the employee to resign, both parties have to give one month's notice (or the notice period mentioned in the appointment letter).
