Understanding Sick Leave and Casual Leave: How Are They Allocated Annually or Monthly?

Please, sir, could you explain the allocation of sick leave and casual leave in a year or month, as well as any information regarding paid leave?

The matter of leaves differs from company to company. However, these are as follows:

1) CL: 8 days
2) SL: 7 days
3) PL: 21 days

Casual Leave can be taken at 2 per quarter, and the CL for the 2nd quarter becomes due only after completion of the 1st quarter.

The procedure for the grant of sick leave and casual leave in a year or month shall depend upon the applicability of the Act, such as the State Shops & Establishment Act, State Industrial Establishment (National & Festival and Casual & Sick Leave) Act, etc. Therefore, first, see which of the acts is applicable in your case and then go through that act to know the answer to your query.

According to the leave policy by law:

Casual Leave (CL)
- 7 days

Sick Leave (SL)
- 7 days (It is not compulsory for every company)

Paid Leave (PL)
- 19 days
- PL even depends on the company's policy.

a. The Factories Act, or b. The Shops & Establishments Act

Then, you look up the law applicable to the state in which your company is located and find the relevant sections in the said state law to get the answer.

Do you mean seeking sick leave during the contribution period is allowable if the benefit period has not started yet? If so, it is okay. Otherwise, it looks odd when the ESI leave is there. Why is the employee availing sick leave? Anyhow, if you are satisfied with the bona fides, it is allowed.
