Dear All, I have some queries related to the rejoining of an employee and need your valuable assistance.

Rejoining an Employee: Key Questions

1. Can we rejoin an employee within 6 months of their exit?
2. If so, what problems may arise in the future?
3. How should we deal with PF & ESIC in these situations?

In my company, this exercise is very frequent, and I always face trouble dealing with it. Kindly help me out.

From rejoin, I am assuming rehire, and it is not reinstatement. Rehire is a new contract between the employer and employee, so there will be a new e-code and all joining formalities will be there.

1. Can we do rejoining within 6 months of exit?

It will depend upon your company's rehire policy. Most organizations do not rehire employees within a year from the exit.

2. If we do, what problems may arise in the future?

In rehire, there is a separate contract between the employee and employer, so I don't foresee any major issues. Ensure that you complete all joining formalities again, and the employee should have a separate e-code.

3. How do we deal with PF & ESIC in the same situations?

If the employee had not received all dues of PF and the PF account is still active, then you can use the same PF account number by completing PF transfer formalities from the old organization. Regarding ESIC, I am not sure; other Senior Officers will help you.
