sethupathy-s
Dear All, As discussed elsewhere in the forum, I am starting this post. I'll post as much as I can on all Labour Acts from my collection, and I request the members to contribute for the benefit of others.

Folder Structure for Labour Acts

I request all fellow members to open a Main Folder with the title of the Act and subfolders inside with the following titles:

1. Bare Acts and Rules
2. Articles on the Act
3. Forms used
4. Judgments on this act
5. Notifications and Circulars on the Act
6. PowerPoint presentations and other Training Materials on the act
7. Excel files
8. FAQ on the act
9. General points on this act

Let us start with the Apprentice Act first.

Nice Mr. S Sethupathy. Please accept my sincere appreciation for your initiatives and acts of deed. Please give 2 days for each act so that you can cover all the materials of the concerned act one by one. If you hasten, it will be difficult for everyone to get acquainted with your speed, and we may skip important portions, similar to how we prepare for exams by focusing only on crucial questions and answers without reading the entire content of the textbooks. There is a Tamil saying, “Nuni pul maeyura Maadu,” which refers to a cow that eats only the edge of the grass, highlighting the importance of not rushing through tasks.

When uploading, please bear in mind that the articles uploaded are not copyrighted materials that could lead to legal action against us. Thank you for sharing your insights.

I agree with you. I wish to mention one more saying from Tamil: "Oru khai thatenayal Osai varathu," which means you can't clap with a single hand. I request fellow members to make comments on the contributions and add color to this with their contributions. I hope you understand this.

Nevertheless, I will keep on adding a few more files on the App Act, and I request the freshers to download all the contents posted by me and other senior members for their future reference.

Regards,
S. Sethupathy,

Erode.

Dear Mr. Sethupathy, Good morning, and you are doing an excellent service to the HR society. I have a doubt here, and I request you to clear the same.

Earlier, women employees were not allowed to work after 7:00 PM, and the same was in force. Some industries (particularly garment industries at Tirupur) had filed a writ and obtained permission to work beyond 7:00 PM if they followed the conditions stipulated in the judgment.

Lately, I read in the Dinamalar newspaper that the court had given a judgment allowing women employees to work at night. I request you to send me a copy of the judgment for my reference.

Thanks and Regards,
J. Narayanan

Dear Narayanan,

New Modifications in TN Factories Rules for Female Employees Working Night Shifts

The new modifications in TN Factories Rules stipulate the following conditions for female employees working night shifts:

- The management must ensure all safety measures are in place for female employees working night shifts.
- A clear route map, including the distance from the factory, for pickup and drop facilities must be arranged.
- Details of the Bus/Van used, including copies of the RC book and information about the drivers and operating times, should be provided.
- A consent letter from female employees agreeing to work night shifts is required.
- Details of security personnel accompanying the transport should be included.

With all the above requirements, you must apply to the Chief Inspector of Factories for an approval order.

I am currently searching for this notification. In the meantime, I am enclosing a few files regarding Women in Night Shifts.

Regards,
S. Sethupathy, Erode.

Dear Mr. Sethupathy,

I sincerely appreciate your efforts. I request clarification on the following doubts to understand the Apprenticeship Act with better clarity and ensure 100% compliance:

a. How long can an apprentice work continuously without a week off? Is it possible to give a week off, excluding one day of the week without considering Form XI? In that case, if the apprentice works for 48 hours per week, their continuous working days may exceed 6 to 13 days. (According to the act, an employee can work continuously for 10 days without a week off – can this be disregarded for apprentices?)

b. What are the rules regarding the week off for apprentices?

c. Can a company engage more company trainees than the approved number of apprenticeships?

d. Can apprentices be directly engaged in production?

e. Are apprentices allowed to work night shifts?

f. Apprenticeship – What training plan should be followed as per the board rules?

g. Can an apprenticeship be extended for one additional month before being discontinued?

h. What are the essential apprenticeship requirements that may be challenging for employers to adhere to?

Thank you in advance.
