Good morning seniors, One of our employees has signed a 2-year bond, but now he has submitted his resignation. Management has instructed me to draft a letter accepting his resignation while also requesting him to reimburse all expenses the company has incurred on his behalf.

If an employee has signed the bond and later resigns from the company, that employee has to pay the liquidated damages to the company. Liquidated damages are the amount mentioned in the service bond.

Dear Aruna, The bond is the most disputed aspect of the contract of employment. Before expressing any opinion, I wish to go through the terms and conditions of the bond. Please attach the bond copy. The Supreme Court and other High Courts have, on many occasions, given decisions against companies that attempted to enforce bonds from employees. We need to study the case.
