I have a query on Gratuity calculation. If a person completes five years of tenure with an organization, will the Gratuity calculation be done from day one or from the date of confirmation? Please reply.

Counting of the service period is to be done from the date of joining.

PF is to be calculated from the date of joining. Gratuity is also to be calculated from the date of joining till the date of leaving.

PF service will be counted neither from the date of joining nor from the date of confirmation, but from the date of registration with PF.

Once an employee is confirmed, they will be eligible for PF contribution. It depends on the probationary period. In some cases, the probationary period may be extended for another three or six months due to unsatisfactory performance.

It should be clarified that a confirmed employee shall be eligible for the PF facility.

For PF calculations, the criteria start from the date of joining the organization with the following conditions:

1. If the organization is registered under the Factory Act.
2. If there are not fewer than 20 employees without power.
3. If there are not fewer than 10 employees with power who have worked in any organization.
